Our Oceans Challenge is an acceleration program and starts with an online open innovation phase that aims for co-creation and empowers contributors to come-up with unique ideas and concept that evolve to thriving impact ventures.
Intellectual Property Rights (“IPR”) means: patents, rights to inventions, copyright and related rights, trademarks, trade names and domain names, rights to get-up, rights in goodwill or to sue for passing off, unfair competition rights, rights in design, rights in computer software, database rights, rights in confidential information or non-confidential information (including know-how, pictures and trade secrets) and any other intellectual property rights, in each case whether registered or unregistered and including all applications (and rights to apply) for and renewals or extensions of, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist, now or in the future, in any part of the world.
All IPR’s retained in this website remain the property of the Our Oceans Challenge. By using this website the Contributor agrees to relinquish all ownership of IP rights pertaining to their online contribution. This includes copyright, right to invention and other IPR’s. If photographs/pictures/figures/images or similar are uploaded, the Contributor guarantees it has the rights to use such images, and hereby grants the Our Oceans Challenge the right to reproduce such images. The Contributor indemnifies the Our Oceans Challenge against any third party proceedings pertaining to the reproduction of such images.
Entries, or portions thereof, may be published by Our Oceans Challenge and/or Partner websites, or in any other medium, at Our Oceans Challenge discretion. Additionally, by participating, all contributors, whether it be an individual or a team, including any companies, legal entities, employees, contractors or any other affiliate or person who has assisted in the entry, grant to Our Oceans Challenge the unrestricted right to use all materials provided or statements made in connection with the Our Oceans Challenge.
By participating, Contributors agree to release, discharge and hold harmless Our Oceans Challenge and their respective partners, affiliates, subsidiaries, agents, and their employees, officers, directors, and representatives, from any claims, losses, and damages arising out of their use of, or inability to use our website, participation in this challenge or any challenge-related activities and the acceptance and use, misuse, or possession of any support awarded hereunder to contributor.
In addition to the above, you guarantee that you are the owner of all information that you post on the Our Oceans Challenge online platform or that you have permission to do so and you indemnify Our Oceans Challenge and their respective partners, affiliates, subsidiaries, agents, and their employees, officers, directors, and representatives, and other contributors against all claims from third parties based on that information.
We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our website or to your downloading or uploading of any content on it.
Our Oceans Challenge attaches great importance to the freedom of expression of its contributors, but is aware too that the Internet may be used in a way that is in conflict with the law and detrimental to third parties. The role of Our Oceans Challenge as a service provider and acceleration platform is limited in this respect: Our Oceans Challenge is only obliged to process requests to remove or make inaccessible manifestly unlawful content that has been posted by its users. Our Oceans Challenge does not carry out any preventive supervision and is not obliged to do so either.
It is possible that Our Oceans Challenge is faced with a for example a court order, with a penalty payment, to remove certain content, for example to prevent or end copyright infringement. In such event, Our Oceans Challenge can remove the relevant content immediately.
